What is a Landlord Responsible for in a Commercial Lease?

If you’re considering renting a commercial property as office space for your business, then you will certainly be thinking about finances. As part of your budget, you will need to be aware of exactly what you are responsible for as part of the lease. It is important to note that all agreements will differ according to the exact terms and conditions of the lease. All arrangements are always agreed upon with the tenant prior to signing the lease to ensure that responsibilities are clear and that everyone understands their role. We will always ensure that the space we provide is safe and fit for purpose. 

As a commercial tenant with Tudor Partnership, we promise to fulfil our landlord responsibilities to you. This includes: 

Fire Safety Assessment 

We will ensure that the premises are safe from fire hazards by carrying out a fire risk assessment and reviewing policies regularly. Any identified risks will be discussed openly and a plan put in place to maintain appropriate safety measures for all staff. 

Health and Safety 

The safety of business owners and all of their staff is of paramount importance to us. Any fixtures and fittings that are present in the building will be maintained by us to ensure they are in good working order and are safe to use. This can include things like lighting and heating. 

Gas and electricity 

Any gas or electric equipment present in the property should be maintained by the tenant according to the manufacturer’s instructions. This may involve a gas engineer visiting the office building on a regular basis to carry out safety checks and inspections. As a landlord, we will ensure that gas appliances and electrical items are properly cared for in all communal office areas. Any items that tenants themselves have installed will be their responsibility to monitor and maintain. 

Asbestos Management

Asbestos management will form part of the health and safety risk assessment carried out on the property. The assessment will outline the risk (if any) and we will ensure that the asbestos is properly managed and that there is no risk to the health of anyone entering the building.  For more information on asbestos regulations, you can view the Government website here

Maintenance and Repair 

The tenant must ensure that the property is kept to a good standard and that the space they are letting remains in good condition during their tenancy agreement. This can mean that the tenant is responsible for general repairs and keeping the place in good working order. Any issues with the structural integrity of the property, or with the building itself, will be properly dealt with by us. We also maintain all communal areas in a shared property such as lifts, stairs, and hallways. 

Minimum Energy Efficiency Standards 

All rented properties in England must have a minimum energy performance rating of E on an Energy Performance Certificate (EPC), we guarantee that all of our properties achieve this.
